These Terms of Service ("Terms") govern your use of the OUTMARK mobile application ("App") operated by OUTMARK ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
OUTMARK is a GPS field-logging tool intended for hunters, anglers, and outdoorsmen. You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:
You must create an account to use social features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.
Certain features of OUTMARK require a paid subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's payment terms. Subscription fees are non-refundable except as required by applicable law or Apple's refund policy. You may cancel your subscription at any time through your Apple ID account settings; cancellation takes effect at the end of the current billing period.
You retain ownership of the GPS pins, notes, photos, and other content you create in OUTMARK ("Your Content"). Uploaded photos and image icons remain private to your account and are excluded from direct shares and shared folders. When you share other content, you authorize us to host, process, and transmit it as needed to provide those features, including automated safety screening of shared text through OpenAI's Moderation API and review of reports by authorized OUTMARK reviewers. Reviewers cannot access your private photos. You grant recipients a limited right to view and use the content you share with them within OUTMARK. We do not claim ownership of Your Content.
Content you choose to share may be screened before delivery. Screening is automated and can make mistakes; flagged content or content that cannot be screened may not be shared. You may report users or content and block users through the app. Authorized reviewers may review reports and available related content, remove content from OUTMARK's sharing services, or suspend sharing access. These actions cannot remotely remove a personal copy another user has already saved.
For one-time shares, OUTMARK removes the delivery copy after the recipient's app confirms a successful save, or when the recipient declines. Older app versions may not be able to confirm a save, so their delivery copies can remain until a supported confirmation or account deletion. A minimal sharing receipt may remain for history. Accepted copies saved to a recipient's account are independent of the delivery copy. Shared-folder content follows a separate lifecycle and remains available to authorized members until removed or the folder is deleted.
OUTMARK requests access to your device's location to log pins and provide map features. Precise coordinates may be stored locally and, when Cloud Backup is enabled, in your private account. They are transmitted to our servers when you back up data, share a pin, add content to a shared folder, or start a Live Location session. Background location is used only during a Live Location session you start and ends when you stop it or its selected time window expires. You may revoke location permission through your device settings; location-dependent features may then be unavailable.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
OUTMARK is a supplemental tool. It is your responsibility to comply with all applicable hunting, fishing, and land-use laws and regulations. Do not rely solely on the App for navigation or safety decisions in the field.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
We may remove shared content or suspend sharing access when needed to enforce these Terms or protect users. We may suspend or terminate accounts for violations or harmful conduct. You may delete your account in the app through Settings → Delete Account, or from Account on the subscription screen. Account deletion does not cancel an Apple subscription; manage or cancel billing through your Apple account settings. Deleting your account does not remove copies another user has already saved.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law principles.
